ISLAMABAD: K-Electric (KE) has strongly criticised the Power Division for actions related to the Tariff Differential Subsidy (TDS), terming them a clear violation of interim orders issued by the Sindh High Court (SHC). In a letter to the Additional Secretary (Power Finance), KE CEO Syed Moonis Abdullah Alvi warned the Ministry of Energy (MoE) to immediately cease and desist from implementing or acting upon review tariff determinations that are sub judice.
KE maintained that the review tariffs have neither been notified nor attained legal finality and therefore fall squarely under Clause 2.1(b) of the TDS Agreement, which requires application of the preceding tariff in case of court restraining orders. The utility further argued that the MoE’s unilateral revision of TDS balance reports violates Clause 2.6 of the agreement and the SHC’s orders, exposing officials to potential contempt proceedings.
KE asserted that only balance reports prepared by the company are legally valid and reiterated its right to pursue appropriate legal remedies.
